These general Terms and Conditions refers to relevant information regarding legal terms on which we (ChromeBurner) sell any of the products listed on www.chromeburner.com/gb/en (site) to you.

Please read these Terms carefully and make sure that you fully understand them prior to purchasing any products on our website. By purchasing a product on our website, you are bound by these terms and other documents referred to on this page.

ChromeBurner Motorgear reserve the right to modify these Terms at any given time at our own discretion – it is therefore important to ensure that every time you wish to purchase on our site, you read and understand the general terms and conditions.

2. Orders

Any order implies acceptance of the prices and description of the products available for sale. ChromeBurner fulfils orders received on the website within the limits of available stock.

At any time, the user / customer can obtain information on the follow-up of their order, either by logging into their customer account (if applicable), or by contacting our customer service.

ChromeBurner reserves the right to cancel or refuse a customer’s order for legitimate reasons – namely and without exhausting the list, in the event of abnormal behavior, poor faith, no stock, fraudulent or potentially fraudulent use or payment. If, for any reason, one of the products purchased by the customer is not in stock, we will inform the customer as soon as possible and offer an alternative product or process a cancellation and refund of the order within a maximum of 7 open days. The order will then be automatically cancelled.

3. Price

The prices of the products sold on our site are indicated in Great British Pounds (£), including VAT and excluding shipping costs which will be calculated during checkout after the customer has filled in the shipping address. If applicable for your invoice and shipping country (for example countries outside of the European Union), VAT may be deducted from your order once the shipping address is complete. For all products shipped outside the European Union, customs duties, other local taxes and or import duties may be applicable. These rights and sums are the sole responsibility of the buyer. ChromeBurner therefore invites the buyer to inquire any local laws with the corresponding local authorities.

ChromeBurner reserves the right to modify its prices at any time. In case of error of a price, ChromeBurner reserves the right to refund the amount and not ship the product. For more information, please click here.

4. Online Contract

Acceptance of these General Terms & Conditions is acquired when the user navigates the site and when the customer clicks on the ‘Place order now’ button on the checkout page. This constitutes an irrevocable acceptance of the order and the General Terms & Conditions by the customer.

5. Product Information

ChromeBurner presents on the site the products to be sold and necessary characteristics, allowing the user / customer to know before placing their order the essential characteristics of the products.

ChromeBurner also provides size charts for most products. These size charts are provided to us by our distributors and should only be considered as recommendations. ChromeBurner is not responsible for any inaccuracies.

6. Shipping

Our shipping costs are indicated in GBP. ChromeBurner reserves the right to change our shipping costs at any given time and without notice. Depending on the time of their order and the type of delivery and the shipping country, the consumer will have to pay shipping costs.

For the United Kingdom, ChromeBurner offers free standard shipping for all orders above 130 GBP.

7. Payments

The customer may choose from one of the following payment methods:

- PayPal
- ApplePay

8. Shipping

ChromeBurner will take great care when receiving and fulfilling product orders. The place of delivery is the address that the consumer has communicated to ChromeBurner as the ‘Shipping address’.

The risk of damage and / or loss of products rests with ChromeBurner until the time of delivery to the consumer or to a designated representative.

ChromeBurner makes every effort to tell the customer about specific delivery times. In some rare cases, our postal services experience delays and fail to transmit this information to us. This implies slight delays in shipping which ChromeBurner cannot in any case be held liable for.

In general, excluding sales periods and end-of-year holidays, any order placed on the site www.chromeburner.com/gb/en before 5:00 p.m. Monday to Friday (excluding international and Dutch public holidays) will be prepared and dispatched the same day, subject to validation of payment and availability of the product.

9. Shipping Methods

Generally – and subject to the shipping country -, the customer can choose between two shipping methods:
- Standard shipping with PostNL
- Fedex

10. Delivery problems due to the carrier

Upon receipt of the package, the consumer must check the condition of the package in the presence of the delivery person. If the consumer finds that his package is damaged, incomplete or has been opened, he must refuse the package. ChromeBurner will then take care of the settlement of the dispute with the carrier.

Any anomaly concerning the products (damage, missing product in relation to the order form, damaged or opened package, broken product, etc.) must be indicated within 48 hours of delivery by sending an email to ChromeBurner (support@chromeburner.com) or by using our contact form.

11. Shipping errors

Once the package has been received, the customer must check the conformity of the order. Any complaint of delivery error and / or non-conformity of the products must be sent to customer service by telephone or e-mail on the same day of delivery or at the latest 48 hours after delivery.

Two scenarios can arise:

One of the products received does not correspond to the indications appearing on the order form present on the Customer Account (reference error). The customer must contact customer service. ChromeBurner will bear the costs of return and send to the customer, if possible, the correct reference as soon as possible, or issue a refund after receiving the product which did not correspond to the indications on the order form.

One of the products is missing: The customer must contact customer service. After checking with our logistics service, ChromeBurner will, if possible, send the missing product to the customer. If it is not possible to send the missing product, ChromeBurner will refund the amount of the missing product.

12. Item ordered not available

In the event of failure to perform the contract by ChromeBurner resulting from the unavailability of the goods ordered, ChromeBurner will inform the customer and offer the customer the following options, if possible:

- ChromeBurner will check the availability of the product at its distributor, and if possible and with the agreement of the customer, order it from the distributor then send it to the customer as soon as possible

- ChromeBurner will offer the customer a product in stock of the same value and same genre (different color, design etc)

- ChromeBurner will offer the customer the option of a refund

If chosen by the customer, the reimbursement of the order will be made within a maximum of 14 working days after receipt of payment for the order.

13. Warranty

All items sold by ChromeBurner on the website www.chromeburner.com/gb/en are subject to a warranty. The duration of the warranty differs depending on the product and the brand in question.

ChromeBurner cannot be held responsible for the misuse and / or heavy use of products. Similarly, ChromeBurner cannot be held responsible for the return of a product not sold on the site by the customer. It is the customer's responsibility to return the correct product.

If your product falls under the warranty of the brand in question, it may be necessary to return the product to ChromeBurner. In this case, ChromeBurner will bear the costs of return.

14. Unclaimed parcels

The consumer has 7 days to collect his package from the relay point or the post office. After this time, the package is returned to ChromeBurner.

In this case, and after having received the package again on the ChromeBurner logistics platform, without any other instructions from the customer, ChromeBurner will cancel and refund the order.

16. Limitation of Liability

The responsibility of the Seller, its agents, employees, subcontractors and suppliers for rights arising from the fulfillment or violation of its contractual obligations, must not exceed the basic contract price and must in no case include losses resulting loss of profit, loss of income, production or use, capital costs, inactivity costs, delays and complaints from Buyer's customers, replacement energy costs, loss of expected savings, increase in costs of exploitation or any special, indirect or consequential damage or loss of any kind. The limitation of liability contained in this clause shall prevail over any other document contained in any other contractual document which is contradictory or incompatible with it, unless this provision further limits the liability of the Seller.

ChromeBurner cannot guarantee the technical continuity of the website, the absence of breakdowns or interruptions of service, or that the website is available or accessible at all times. Nor can it guarantee the absence of viruses or other harmful components on the website or on the server from which it is provided.
